i'm equally confused by barack obama. he said quite clearly a couple years ago it's not a tax and never going to be a tax. now he's saying the supreme court says i can do it through taxation. it's a great idea. is it a tax? that's the way can he do this. >> there's a good reason why you're confused. the court says very clearly at the outset that it's not a tax because if it were a tax the court could not have reached this decision. there's something called the anti-injunction act which says you can't challenge a tax until you actually have to pay it. what the court also said is the act could be upheld under congress's taxing powers. there are lots of exactions and lots of penalties and moneys that people have to pay under the congress's taxes power that may not necessarily be a tax. piers, i want to go back to another point you made. it's interesting what both the congresswoman and kellyanne do. it's watch watching people do this sometimes you repeat something long enough, perhaps it becomes true. even if you considered t
